Its a good idea Chewy and one that i do a lot of......only problem is movement of large amounts of material.

I usually only bring material home when i want to sample in areas with no water, being in VIC, if there is a dam around i will use my pump with banker on location because i can under my miners right.

Have about 15 (20ltr) buckets which will fill any void left in the back of my wagon to bring home, otherwise you would need a small trailer which is not an option since i tow other equipment already.

Good to see you stand up for the fight Yobskin.....you have my support mate! only a PM away.

fully agree with goldtarget.
But if you guys need support then im in, suggest you use Change.org, to start a petition, but dont limit it to Qld prospectors, there are a lot of people out there that are willing to support, they just need to know about it.

Boyd, give me one example of when a petition was successful in changing what is law?

The MP's concerned wont even acknowledge it.....it will be dispensed as parliamentary toilet paper in the cubicles to save on costs!

Thats why we are losing, its 2015 and we are still promoting 80's technology.

If you agree with GT, what we need are high paid Lawyers to challenge these points in a court of law on our behalf, like the yanks did.

Yes, its all about money and votes.....We dont have the numbers to effect votes for a change in govt thinking, so we must put our money where our mouth is to have any effect at all.
 
The strange part about it was he said....i dont care of you dig a 4m shaft or dig out the banks...when it clearly states 3m top to toe on banks...and only 2m in depth...i asked so we can only process a cubic meter of material in 48hrs ....he laughs and replys with mate where are you getting your info from???
We dont care if ya process 40tonne for the day....and the other thing you guys have got wrong is you cant walk up creeks from road reserves or bridges it private land. He quotes check you border map...? He took a picture of my permit...instead of just looking at it. Like ya do when gathering evidence....
How can he be so adimit about water pumps when he is so loose with the actual detailed part about digging?

I dont know how im going to start this....

Or maby i have already...high banking on sunday see if he wants to drive up on his day off! Get some attension and a no win no pay lawyers...
 
Forgot to mention...electric bilge pumps and solar power is illegal to. I told him that was just being picky ...i think he was having fun pushing me buttons...little did he know under my calm exterior i was about to throw him and his i-pad in the drink!
I will always have respect for anyone whom is responsible for upholding the law regardless of the situation.
Prospectors have evolved over the years we have learned to look after and look out for our environment for every-ones future. Not just our own.
We are now educated our techniques and technology has evolved and now the laws need to evolve ..... 1996 was when they were set its 2015.
I didn't mind sitting back in the grey area for awhile but if this is how an inspector interprets the grey area....we are surely doomed. The guy whom gives you the fine at the end of the day doesn't see grey.

We're having the exact same problem in Tasmania. Abuse by unlicenced cowboys is being used by the regulators to tighten the regulations. This is a totally nonsense argument, as the people causing the problem are not licenced in the first place, and therefore don't have to abide by any regulations. We've decided to form an association. We will be having our constitutive meeting in the next week or two. PM me if interested in being involved.
We have at the moment just about the most sympathetic Government to our hobby that we're likely to see. We'd be silly not to use this to our advantage.
 
Im starting at the bottom locally i feel legitalising the small water pump would be beneficial to my town to help boost tourism...i would really like to see my southern brothers and sisters up here on a fossicking holiday! Imagine that!
I feel I've got too much on my plate atm for this? but something inside me says i could do this or get some ones attention.

I thought of holding an assembly handing out petition information leaflets but that's illegal too....hahahaha

Im using the honey method lads...no one likes a pushy screamer.

I personally wouldnt go down that avenue. . Either u can pump water or you cant ... my pump is overkill but I only run it to suit my banker which is mini anyway... BUT I can run it very quietly at idle and draw from any depth or distance needed and also run several bankers if needed. Id hate to have a rule that said over 1.5hp is to big etc.

Nah mate more like "machinery" should be classed as industrial/commercial size...not a little 6hp-1.5hp hobby pump.
And yes the issue is about pumping water but you have to cover all bases...changing something like this will need evidence and probably a sacrafice.

And the ball has started to roll.... my town has a fossicking area that isnt being utilised? It should be a tourist hot spot.
 
I reckon until they write into the something like

"No mechanical means or pumping of water to process collected material from fossiking " they have zero grounds.

There does not appear to be anything specific that says otherwise. The only grey area is if your pump is too loud or you don't put the water back into the watercourse.

I still think you could bucket feed the water even if they did. I'm not in qld mate but I'd fight it after the infringement notice if I was.
Maybe a recirculation system that you supply the water? Shovel from a bucket of sieve material?

I reckon any Qld fossiker with a bit of depth of character would beat the perceived infringement. You aren't full scale mining after all which appears to me to be the angle the rules have been drafted from, just to ensure nothing gets out of hand not force you just to wash in a pan.
