Sure hope these heroes get the maximum sentence, without someone pleading about their deprived childhood and difficult times.

That would not appear to be possible if convicted, because of mandatory sentencing laws - and deprived childhood and difficult times don't have any influence on whether someone is actually found guilty.

Western Australia
4.8 In WA, mandatory penalties apply to convictions for grievous bodily harm offences;

4.9 In WA, a mandatory minimum term of imprisonment75% of the maximumis imposed upon conviction for causing grievous bodily harm when committed in the course of an aggravated home burglary.The maximum penalty for grievous bodily harm is 10 years imprisonment, or 14 years if committed in circumstances of aggravation. This means that an offender would receive, at a minimum, seven and a half years, or 10 and a half years imprisonment.

4.10 Western Australian law also imposes a minimum term of imprisonment for repeat burglary offenders. An adult offender with two prior convictions for burglary must, upon the third conviction, be sentenced to at least two years imprisonment.

Our system is not nearly as lenient as most people assume. Most States have some mandatory sentencing laws for serious crimes. We hear about the anomalous exceptions in sentencing and remember them (commonly from press reports that exaggerate issues relating to sentencing, such as forgetting to mention that someone has already been in gaol for 18 months awaiting trial - it does not sell papers to discuss sentences that everyone would agree with, b ut it does to discuss - and often misrepresent - the exceptions), However there have been a few glaring examples of inadequate sentencing where no mandatory laws exist, but in many cases these have subsequently been over-ridden on appeal.

The public defenders will no doubt try to present those offenders as the real victims. One of the offenders was an adult, so the first hearing was reported. His name is Coolio Derek Mears.

Here are some details. Apparently one of them is facing separate charges for assault occasioning grievous bodily harm.

In relation to Goldirocks observations, it appears that they have not been charged with GBH (see above). Also, while I am not certain of the WA system, it is unlikely that mandatory sentences would apply to defendants appearing in the Children's court.

Scum! We see this all the time now and I am afraid that it is only going to get worse as Police are limited and courts are overflowing with Covid added, the judicial system doesnt want to lock them away.
Very interesting Dr.Duck and other contributors.

I forgot the link for the initial hearing.

"Coolio Derek Mears, 18, along with the two other youths aged 16 and 17, who cannot be named for legal reasons, are facing a litany of charges, including home burglary, aggravated armed robbery and aggravated assault occasioning bodily harm.

The two younger alleged offenders faced Perth Childrens Court where it was revealed the 17-year-old was due to face a trial next week on a charge of grievous bodily harm from a separate incident.

All three were remanded in custody, with the case adjourned because the magistrate wants further evidence from WA police. "

It is often more State governments who ultimately dont want to build more prisons. But they have mostly responded with mandatory sentencing for more severe crimes.
