hi im a newby and was wandering just to go swinging around some parks and beaches do you need a miners rights :rolleyes:
 
Welcome to the forum mate. Where abouts are you planning on swinging?
 
Victoria? No you don't for suburban beaches and parks. detect in any vic state forest - yes you do.
 
no worries Kev - the rules can be a bit vague at times. For example, there is a 'park' at Dunolly (actually the Deledio Reserve where the footy is played) that is Crown land and the responsibility of the DEPI so technically, if you were going to detect it, you would need a miners right. Remember, some QLD tool dug up the Maryborough (Vic) Footy Oval this year detecting and got fined. He thought his Miners Right covered this which was actually an act of vandalism - wilful damage I think they got him for. 80+ holes I think it was.

This is from the FAQs for Miners Rights: "A Miners Right is a permit to prospect for minerals on unreserved Crown land or private land where the permission of the landowner has been granted." See the full blurb at:

Note: If on Private land, a Miners Right is required - go figure that out?!

That would be because, across Australia, the Commonwealth owns any gold and silver in the ground, regardless of land tenure.
