MINERAL RIGHTS ARE RESERVED BY THE CROWN.

This is what it says on the Title Deeds for the 1200 acre property where I live. I have a 10% share as Tenant in Common. It's about 2 hours drive from Grafton NSW & before I start prospecting, I need to know if this just means I must obtain a Licence? Or does the Queen get any minerals I may find?

What must I do & pay to claim exclusive mining rights to, what has been agreed, is my 120 acres of the property?

If I find gold, where can I sell it? To pay for the Licence?

In NSW if you are only fossicking/prospecting then you don't need a licence/permit outside of NSW State Forests.

Even though you own the land if you want to operate/mine outside of the NSW Fossicking Guidelines i.e. use machinery then you do need to get a licence to suit. Info here:

Edit: P.s when complying with the above rules/regulations, as a fossicker/prospector or miner, any minerals found revert from the Crown & become your property. :Y:
If found to be non compliant you risk losing any minerals recovered &/or being fined + prosecuted. The NSW Resource Regulators have powers/rights to enter onto any property where illegal activity is suspected.
 
All minerals belong to the Crown in every State. In Australia the Crown is vested in each State and Territory. A mining company or individual miner if not a company has to obtain a mining lease to mine and pay a royalty on the minerals owned by the crown. An exploration company must obtain an exploration licence or equivalent to explore only. A fossicker does not need to obtaining a mining lease or an exploration licence. If it's being done as a hobby then if you sell any gold or gems then royalties and tax do not apply. Note if you want to start a quarry, open cut or underground mine you are by definition mining and must have a lease. Then also environmental bonds apply and inspections and the list goes on and on.

I can't find anything regarding test holes in the plethora of double dutch legalese in those links.

As a NSW fossicker, I can dig test holes, with a hand post hole tool, crowbar &/or shovel, so long as I take out no more than 1 cubic metre of soil, every 2 days?

What sort of Licence will I need for mechanically dug test holes? How much will it cost for a Disabled Pensioner?

I'm both an Aged & a Disabled Pensioner with high blood pressure. I've just bought a Minelab Go-Find 22 detector, because I need more exercise. The past 25 years have been spent building most of my stone, steel, glass & concrete house, on the side of a mountain, that's on the property. Also many stone terraces & swales for bushfire protection. There are patches of white quartz & there was some small scale mining activity, on my 120 acres, 60-70 years ago.

Can a NSW fossicker use a yabby pump or small sluice that runs on the flowing water in a creek? What kind of Licence is needed if a solar driven pump if used?

The last time I checked, Pensioners DON'T need a Fishing Licence in NSW. I can fish for yabbies, if I carry my Pension Card.

In NSW you cant use power operated equipment to fossick and that included solar powered. You can use a yabby pump and a river sluice.

I believe that if you want to use mechanical equipment to test an area then you would have to take out an exploration lease on the area and there are no pensioner discounts available.
You also need to check that your property isnt already covered by a mining lease or exploration lease a huge part of NSW is already under some type of lease.
 
If youre are on a farm there is a chance you might use a petrol powered or tractor driven auger to do your fence post holes.

Where you put the excavated soil is entirely up to you.

If I start drilling fence post holes and I happen to find nice nuggets , I might decide its not the best place for a fence anyway but it may be a good spot for a dam.

On my days off I can play around in my prospecting hobby anywhere on my own property which means I can have a little dig with the shovel any damn place I like.

If I set up a small sluice, near my house & hand carry or wheelbarrow hand dug paydirt to it, can I use the water in my 3 rainwater tanks to sluice it, as a fossicker in NSW? I can use the excess water on my gardens & the sand & gravel will become future concrete or mortar.

As a fossicker, I can recycle the water if I continually lift & empty the bottom bucket back up to the top? For a 72 year old cripple, with 3 prolapsed discs in my lumbar spine, this will be a cruel & unusual form of torture.!

Via wind & solar I'm self sufficient for power. I haven't started my petrol generator for 4-5 years. The 2 systems cost me $15K and in terms of the unleaded petrol I would have bought, it's now paid for itself & is FREE.

What Licence will I need, in NSW, if a motorised pump is used to recycle water or paydirt is carried in a vehicle? How much will it cost?

What is an Assessment Lease?

If a NSW fossicker finds a meteorite or fossil, can he/she legally sell it?

Before you get too carried away buy a gold pan & test the areas you suspect might have gold.
There's no use carting dirt, setting up sluices & getting tied up in knots about what licence/s you may or may not need if no or very minimal gold exists.
An Assessment Lease basically allows an explorer to hold an authority over an area without having to continue exploration work (but you can if you want to). I assume you would need some level of proof a mineral resource has been proven. Doesn't give the holder rights to mine.
 
So far I've spent $229 on a metal detector. When I've recovered that amount, in minerals, I'll move on to the next step in a LONG process. I have a borrowed gold pan. I'm still experimenting/tuning the detector on known coins, pop rivet nails & bits of wire, around the house. There's a few targets I haven't dug yet. The ferrous metal excluder function on my Minelab Go-Find 22 is tricky.

I agree with mbasko. I know there's gold here. The question is...How hard is it for a NSW Fossicker to transport & extract, USING NO MECHANICAL MEANS.

In the meantime, I'm still trying to discover what my present rights, liabilities & obligations are.

If I find an unauthorised detectorist on my land, can I make a Citizens' Arrest, with a compound bow & arrows? If I wave a detector over them to check for pocketed nuggets, is it likely to do harm?

With my eyes & hands, I've seen & held a fist size piece of white quartz, with several visible veins of gold running through it. It was found by an upstream neighbour. My downcreek next door neighbour, who loaned me his only gold pan, said the fellow he bought the land from, had " found a few flakes".

The next steps will be obtaining exclusive mineral rights by leasing them from The Crown, for ? years, $??.?? and a ? Mining Lease. Can The Crown also charge me Royalties, based on the amount of gold extracted?

How many ounces will I need to fossick to pay for this + more hand tools?

If an over zealous Mine Inspector sees me driving to & from a spot I'm prospecting, I've used a mechanical transport implement. Is a fine of many thousands of $'s ( + ? points ?) likely? Do I have to start walking everywhere?

What happens with their Rule about how much gold a fossicker can take from Crown Land, over a 2 day period, if a HUGE nugget is found? How often are they chopped up, due to this condition?

Will I need to employ a Legal Officer to find a path through these minefields of ******** bureaucratic balderdash?

We are almost surrounded by several State Forests.

On my 50th birthday, I tried climbing the mountain, to see if I was over the hill. I didn't fall off the other side, so I guess I wasn't. While up there, I noted a very heavy, weather worn, out of place black rock, the size of a large rockmelon. I've since learned that it's probably a meteorite. If it's still there, I can sell it & recover the money I've spent, so far, + wages. I'm waiting for a cloudy day, so I can spend most of it up there, with my detector & a magnet.

Would it be possible for an esteemed Forum, such as this, to ask the Dept. Mines to help promote Sustainable Energy, by allowing NSW Fossickers to use NON polluting, solar driven pumps for sluicing & water re-usage?

How about a petition? I'll sign it, if someone else wants to organise it.
