exploration lease on a river

As far as I know rivers are crown land and if you have a river/creek running though your property people are allowed on it up to the high water level . But with a lease on it I wouldn't know
 
I would think the lease would cover the river, I believe in Qld it covers all material down to 2 meters. It could be different where you live HeadsUp
 
Technically you are meant to get permission. But no one actually does as it's not enforced. The only time you will be asked to leave is if they are working in the area. I assume you were talking about NSW.

FYI
In QLD if ground is covered by an "Exploration lease" (Known as an EPM) as most of the "Goldfields" are, the only permission that is required by law is that of the "Land Holder" pastoralist, there is no requirement to get permission from the "Exploration Licence" holder, even they are required to notify the landholder of their activities.

this is in NSW but i will be meeting with the land owner of the property adjacent to the river
 
In Qld if I own the property that has a EPM on it, am I able to stake a claim ? I presume I wwould need permission from the EPM owner, or have they got first rrights to the land to stop me making a claim on my own property?
 
Hey Brisjoe

The EPM holder has the first rights to all claims or leases, you can ask permission to take up some of the sub-blocks if they are happy to relinquish them.
But bearing this in mind & depending on the deposit & their method of operation, once you let them know the area you are interested in they will be all over it looking for what you think you have, better to say nothing & bide your time I think!! that is what I will do.
Do a bit of questioning of your mining registrar to see if you can put in an early application (confidentially) to take on the sub-blocks when they come available.
Good luck out there, there are many small deposits that would be very lucrative for small operators if they cut back the red tape a bit.
